What is planning and zoning?

Planning and zoning guides how Boyle County grows and develops by making sure land use decisions create safe neighborhoods, reliable infrastructure, and support community goals.

Why does Boyle County have planning and zoning?

Planning and zoning helps ensure development is safe, coordinated, and consistent with community goals for housing, roads, and public services.

How was the Danville-Boyle County Planning & Zoning Commission created?

Boyle County and its incorporated cities agreed to adopt a single, joint zoning ordinance. Under KRS 100.121, they established a joint planning and zoning commission to regulate it.

Who makes up the Planning & Zoning Commission?

The Boyle County Planning & Zoning Commission is a joint agency formed by Boyle County Fiscal Court and the city governments of Danville, Junction City, and Perryville. Members are appointed by these local governments and approved by their legislative bodies:

  • Boyle County Fiscal Court: 4 members

  • Danville City Commission: 4 members

  • Junction City Council: 1 member

  • Perryville City Council: 1 member​

What is the structure of the Planning & Zoning office?

The Planning & Zoning Commission is a quasi-agency to oversee planning and zoning for the entire county. Under its jurisdiction are:

  • Planning & Zoning Commission (P&Z) – Oversees zoning ordinances, subdivision regulations and approvals, and the Comprehensive Plan.

  • Board of Adjustments (BOA) – Handles variances, conditional use permits, and appeals.

  • Danville Architectural Heritage Board (DAHB) – Reviews design standards for historic districts.

LEGAL STRUCTURE

What law gives Boyle County this authority?

Kentucky Revised Statutes (KRS Chapter 100) gives counties and cities the authority to create planning and zoning commissions and adopt zoning rules.

What does “quasi-agency” mean?

"Quasi" means our Planning & Zoning Commission is created by several local governments working together, instead of being a part of just one city or one county government.

How do city commissions and the Fiscal Court work together?

The Boyle County Fiscal Court, the Danville City Commission, the Junction City Council, and the Perryville City Council all share responsibility for adopting zoning ordinances and appointing members to the Planning & Zoning Commission and Board of Adjustments. This ensures decisions reflect both county and city interests.

How does the Board of Adjustments fit into Planning & Zoning?

The Board of Adjustments (BOA) provides flexibility within the local ordinances by reviewing variances, conditional use permits, and appeals of zoning decisions. This ensures that exceptions are handled fairly while following local ordinances and KRS.​

How does the Danville Architectural Heritage Board fit into Planning & Zoning?

The Danville Architectural Heritage Board (DAHB) helps protect the historic district’s character. They review changes to building exteriors, signs, and other visible features in the historic overlay district to ensure projects respect the area's historic character and meet local, state, and federal guidelines.

ROLE OF THE PLANNING COMMISSION

What is a Zoning Ordinance?

A zoning ordinance is a set of rules for how land can be used, such as residential, commercial, or industrial. It helps keep development organized and cohesive.

What are Subdivision Regulations?

Subdivision regulations set standards for dividing land into lots and adding infrastructure like streets and utilities. Sub-regs make sure new neighborhoods are safe and well-planned.

What is a Joint Zoning Ordinance?

It’s an agreement between Boyle County and its cities to share one set of zoning rules. This creates consistency across the county and makes development easier to manage.

What is a Comprehensive Plan?

The comprehensive plan is a long-term guide for growth. It looks at housing, transportation, utilities, and land use to make sure development supports the community’s vision. State law requires updates every five years.

What is the Future Land Use Map (FLUM)?
The FLUM is part of the Comprehensive Plan. It shows how land is expected to be used in the future and helps guide zoning decisions.

PROCESSES, PROCEDURES & PERMITS

What is a zoning permit?

A zoning permit confirms your project meets local zoning rules, such as setbacks, land use, and complies with the approved site plan.

What is a building permit?

A building permit ensures your construction meets safety and building code standards. It’s issued by either the local or state building inspector, depending on size and location.

What is a setback?

A setback is the required distance between a structure and the property line. It ensures safety, privacy, and access for utilities.

What is a variance?
A variance is permission to break a zoning rule (like a setback) because of hardship. It requires a public hearing and approval by the Board of Adjustments.


What is a conditional use permit?
A permit that allows a specific use (like a daycare or church) in a zone where it’s normally not allowed, if conditions are met. It requires a public hearing and approval by the Board of Adjustments.

What is a zone change?

A zone change means changing the zoning classification of a property. It requires a public hearing and approval by the Planning Commission.

How can I find out what my property is zoned for?

Check the zoning map on our website or contact the Planning & Zoning office. We’ll help you verify your property’s zoning classification.

​What are the rules for signage?

Signage rules can be found in the zoning ordinance. They cover size, location, and type of signs allowed. Contact the Planning & Zoning office before installing or updating any signs.

Do I need a permit to build a deck, detached garage, or accessory structure?

Yes, most of these projects require a zoning permit and/or a building permit. Contact the Planning & Zoning office first.

Where do I go for permits?

For zoning permits, contact the Danville-Boyle County Planning & Zoning office. For building permits, contact the Boyle County building inspector, Mr. Rusty Cox. If you need a building permit, you will probably need a zoning permit as well, so please contact our office to make sure you have all the required permits.​

Do I need to hire a lawyer?

A lawyer is never required for any application, but you may hire one if you prefer.

PARTICIPATION & OVERSIGHT

When are public hearings held?

All meetings of the Danville-Boyle County Planning & Zoning Commission, the Board of Adjustments, and the Danville Architectural Heritage Board are open to the public.

  • Board of Adjustments: 3rd Tuesday of the month, Danville City Hall at 5:30 PM

  • Planning & Zoning Commission: 4th Wednesday of the month, Danville City Hall at 9:00 AM

  • Danville Architectural Heritage Board: 3rd Wednesday of the month, Danville City Hall at 1:00 PM

Meeting dates and times can change due to scheduling or a lack of quorum. Updated schedules are always posted on our website and published in The Advocate-Messenger. All meetings are streamed live on the Danville City YouTube page.

How can citizens participate in decisions?

What if I disagree with a Commission or Board decision?
You can appeal decisions under KRS Chapter 100. Contact our office for details.


How do I report a zoning violation?
Call or email the Planning & Zoning office. We’ll research and follow up.
